Official Rules

1. Eligibility and Permission

Void where prohibited. Contest is open to any person 18 years of age or older as of their date of entry. No purchase is necessary. Entrant

By entering this contest, entrant agrees to allow his or her email address to be used by ThePowerXChange and/or X-Ray Magazine for the purpose of sending future promotions to the entrant. Entrant may opt out of this list at any time without affecting his or her eligibility for winning X-Ray Magazine's $25,000 Software and Other Cool Stuff Giveaway. Employees and members of their families or households of ThePowerXChange, X-Ray Magazine, and all participating prize providers are not eligible for participation.

Acceptance of a prize shall constitute and signify the winner's agreement and consent that ThePowerXChange and X-Ray Magazine may use the winner's name, likeness, and/or prize information for advertising and promotional purposes in any media without further compensation, except where prohibited.

2. Prize

The grand prize may include, but is not limited to, software XTensions, Plug-ins, applications, utilities, fonts, and stock images with a total combined retail value of more than $25,000. For applicable products, winner may choose the platform, application compatibility, and delivery format (boxed or electronic).

By claiming the prize, the winner waives the right to claim any cost of winning the prize including, without limitation, any and all costs of verification and redemption, or travel to redeem the prize, and bears in full any liability that might arise from redeeming or seeking to redeem the prize. Winner agrees to pay any shipping and/or freight expenses, taxes, surcharges, or penalties assessed or levied by any authorized agency or transport company. The prize is non-transferable and must be accepted as offered, as there will be no substitutions and no cash equivalent.

ThePowerXChange and X-Ray Magazine will make up to three good-faith attempts to deliver the prize. If the third attempt is unsuccessful, winner hereby agrees to forfeit the entire prize and another entry will be randomly drawn from the remaining eligible entries received.

3. Award of Prize

A random drawing will be held on 1 March 2008 from all eligible entries received and every effort will be made to notify the selected entrant by telephone within 7 days of the drawing. Individual software products may be delivered separately. The entire package will be delivered within six weeks of the winner having provided all qualification requirements. Some software products may require pre-registration to prevent transference of license rights.

The chances of winning are dependent upon the total number of eligible entries received.

Requirements of the winner Before being declared the winner, the selected entrant will be required to sign a release form, confirming compliance with the contest rules, acceptance of the prize as offered, and releasing the participating sponsors, ThePowerXChange, X-Ray Magazine, and their respective employees and agents from any responsibility for any injury, accident, loss, damages, misfortune, or expense resulting from the use or enjoyment of the prize.

If the selected entrant is unwilling or unable to comply with the contest rules within two weeks of the drawing, the selected entrant will be disqualified and another entry will be randomly drawn from the remaining eligible entries received.

4. How To Enter

X-Ray Magazine's $25,000 Software and Other Cool Stuff Giveaway begins 12:01 AM (MT) 15 January 2008 and ends 29 February 2008 ("Entry Period"). X-Ray Magazine's $25,000 Software and Other Cool Stuff Giveaway is sponsored by ThePowerXChange, LLC, X-Ray Magazine, and Quark. Additional sponsors may join during the sweepstakes, and those companies will be added to this section of the offical rules.

To enter, visit click here during the entry period, fully complete the online entry form including questions, then click to submit.  Limit one entry per person. Duplicate entries will be discarded. Incomplete entries are ineligible. Entry must be through human submission — use of automated entry software or entry through other mechanical or automated computer means is prohibited.

To enter by mail, send a 3 X 5 inch card on which you have hand printed your first and last name, address, telephone number, and e-mail address to: ThePowerXChange Contest Entry. 1445 Lamar St, Lakewood, CO, 80214.

Entry forms must be e-mail or mailed and received no later than 29 February 2008, 12:00 PM, Mountain Daylight Time, the contest closing date.

Neither ThePowerXChange nor X-Ray Magazine is responsible for postal system, telephone, network, electronic, or computer failures of any kind, or for entries that are incomplete, garbled, delayed by computer transmissions, misdirected, lost, stolen, or otherwise illegible. All entries become the property of ThePowerXChange and X-Ray Magazine and will not be returned to entrant.

Void in Puerto Rico and wherever else prohibited. If the random winner is chosen in a country, state, or region that prohibits such promotions, winner automatically forfeits prize winnings and another entry will be randomly drawn from the remaining eligible entries received. No winnings will be distributed until the winner's country and regional rules regarding the receipt of such a prize can be verified.

5. General Conditions

Errors or omissions Sponsor is not responsible for printing or typographical errors in any sweepstakes-related materials, deleted, lost, late, misdirected, damaged, incomplete, or illegible entries. Sponsor, and it affiliates, subsidiaries, advertising and promotion agencies, and internet access providers are not responsible for incorrect entry of information by entrants, or technical malfunctions of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, human error, or lost/delayed data transmission; or transactions that are processed late, incorrectly or lost due to computer or electronic malfunction. 

Waiver By entering the sweepstakes, winner and entrants agree to waive any and all claims against the sponsor, its affiliates, employees, agents, and representatives for personal injury or loss, that may occur from participation in the sweepstakes or from the receipt of use of any prize. 

Entry validity In the event of a dispute over the identity of an internet entrant, entry will be deemed submitted by the holder of the e-mail account at time of entry. Entry materials that have been tampered with or altered are void. No copies, facsimiles or reproductions of online entry form will be accepted. Proof of e-mailing does not constitute proof of delivery. If sponsor determines in its sole discretion that any suspected or actual electronic tampering with the promotion occurs, or if technical difficulties compromise the integrity of the promotion, the sponsor, at its sole discretion, reserves the right to void any entries submitted fraudulently and cancel or modify the promotion. Any attempt by any entrant or any other individual to deliberately damage any web site or to undermine the legitimate operation of the promotion is in violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. X-Ray Magazine and/or ThePowerXChange reserve the right to reject any individual submission that is deemed to be fraudulent.

Early termination of contest Sponsor reserves the right, at its sole discretion, to cancel this promotion if it becomes technically corrupted such that it cannot be conducted as originally planned and select winners by random drawing from among all eligible entries received by this termination date. Should the promotion be terminated prior to the stated expiration date, notice will be posted here as an addtion to the official rules.

No warranty SPONSOR AWARDS PRIZES SUBJECT ONLY TO MANUFACTURER'S WARRANTY, WITHOUT WARRANTY BY SPONSOR OF ANY KIND, EXPRESS OR IMPLIED, WITHOUT LIMITATION. SOME MANUFACTURERS RESTRICT THE TRANSFER OF THE SOFTWARE LICENSE.

Compliance with US tax regulations Contest is subject to all applicable federal, state, and local laws and regulations. It is the policy of the sponsor, in compliance with United States Internal Revenue Service regulations, to send a Form 1099 to any winner, that resides in the United States, receiving a prize valued in excess of $600 (USD), that requires the disclosure of the winner's social security number. The winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply in their state of residence.
